Terms of use

We do not provide emergency care services. If you are experiencing a mental health crisis or a medical emergency, call local emergency services immediately (in India, dial 112).
Please read these Terms of Use (the “Terms”) and our Privacy Policy carefully. They govern your use of the website located at https://amcareindia.com (the “Site”) operated by Amcare India (“Amcare India,” “we,” “our,” or “us”). Our physicians provide medical and telehealth consultations (the “Professionals”). The Site and our services, including medical and telehealth services arranged through the Site, are collectively called the “Services.”
1. Agreement to Terms
By using our Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
2. Privacy Policy
Please review our Privacy Policy, which also governs your use of the Services, for information on how we collect, use, and share your information.
3. Changes to these Terms or the Services
We may update the Terms from time to time. Updated Terms will be posted on the Site. If you continue to use the Services after we post updates, you accept the changes. If you do not agree, stop using the Services. We may change or discontinue any part of the Services at any time.
4. Who may use the Services
You may use the Services only if you are at least 18 years of age (or such other minimum age at which you can consent under the laws of India), and not otherwise barred under applicable law. If you are a minor, a parent or legal guardian must agree to these Terms on your behalf and is responsible for your use of the Services.
5. Disclosures regarding content and Services
Content on the Site is for informational purposes only. Information on the Site does not create a doctor–patient relationship, is not an aid to making personal medical decisions by itself, and is not intended to diagnose, treat, cure, or prevent any disease. Site content is not a substitute for professional medical advice, diagnosis, or treatment. Never disregard professional advice or delay seeking it because of something you read on the Site. If you think you may have a medical emergency, call local emergency services (112 in India) immediately.
Our Professionals are responsible for professional services they provide. Submitting the interest form or contacting us does not by itself create a doctor–patient relationship. That relationship begins when a Professional accepts you for care and provides a consultation. You should seek follow-up or emergency care as needed and continue to consult your primary care provider or other clinicians as appropriate.
Telehealth (video or phone) consultations have limitations: information available to the Professional may be incomplete compared with an in-person exam; technical failures can disrupt care; and electronic communications are never completely risk-free. Professionals take these limitations into account, but risk of error exists. You may choose in-person care at our Lucknow clinic (Omaxe R2) instead of or in addition to telehealth, subject to availability.
6. Scheduling (no online booking or payment on this Site)
This Site does not offer online appointment booking, live calendar slots, patient login, or admin access. You request a call via the interest form or contact channels; our team schedules consultations offline. Fees, if any, are communicated when scheduling. You remain responsible for charges agreed for Services you receive.
7. Communications (phone, WhatsApp, email)
If you provide a phone number or email, you authorise Amcare India to contact you about your enquiry and scheduling (including WhatsApp where you initiate or accept that channel). Message and data rates from your provider may apply. Text and messaging apps may not be encrypted end-to-end in all cases; do not send urgent medical information solely by message if you need immediate care.
8. Feedback
If you submit feedback, ideas, or suggestions about the Services, you agree we may use them without restriction or compensation to you.
9. Prohibited uses
You agree not to:
- Post or transmit content that is unlawful, fraudulent, defamatory, harassing, or that infringes others’ rights
- Attempt to probe, scan, or breach security of the Site or interfere with other users’ access
- Use the Site for spam, scraping (beyond ordinary browsing), or unauthorised commercial use
- Impersonate any person or entity or misrepresent your affiliation
- Violate any applicable law
We may investigate violations and cooperate with law enforcement. We may remove or disable access to content that violates these Terms.
10. Third-party links
The Site may link to third-party websites or services we do not control. Your use of those resources is at your own risk and subject to their terms and privacy policies.
11. Termination
We may suspend or terminate your access to the Site at our discretion. You may stop using the Site at any time. Provisions that by their nature should survive (including disclaimers, indemnity, and limitation of liability) will survive termination.
12. Warranty disclaimers
THE SERVICES ARE PROVIDED “AS IS,” WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that content is accurate or complete. General advice on the Site is informational and not a substitute for a personal consultation.
13. Indemnity
You will indemnify and hold Amcare India and its officers, directors, employees, and agents harmless from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Services, your content, or your violation of these Terms—to the extent permitted by applicable law.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER AMCARE INDIA NOR ITS SERVICE PROVIDERS WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM THESE TERMS OR USE OF THE SERVICES, WHETHER BASED ON CONTRACT, TORT, OR ANY OTHER THEORY—EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING FROM THESE TERMS OR THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICES GIVING RISE TO THE CLAIM IN THE TWELVE MONTHS BEFORE THE CLAIM, OR ONE THOUSAND INDIAN RUPEES (₹1,000) IF YOU HAVE NOT PAID US, WHICHEVER IS GREATER WHERE REQUIRED BY LAW.
Nothing in these Terms excludes liability that cannot be excluded under Indian law (including liability for death or personal injury caused by negligence where such exclusion is prohibited).
15. Governing law
These Terms are governed by the laws of India. Subject to mandatory protections available to you as a consumer, courts of competent jurisdiction in Prayagraj, Uttar Pradesh, India shall have jurisdiction over disputes arising from these Terms or the Services.
16. General
These Terms are the entire agreement between you and Amcare India regarding the Site. If any provision is held unenforceable, the remaining provisions remain in effect. You may not assign these Terms without our consent; we may assign them. Notices may be given by email or by posting on the Site.
